4. Payment Service Provider
The payment services (collection, safeguarding and transfer of funds) offered on the Platform are provided by:
Lemonway — simplified joint-stock company, registered office 8 rue du Sentier, 75002 Paris, registered with the Paris Trade and Companies Register under number 500 486 915, authorised as a payment institution by the Autorité de contrôle prudentiel et de résolution (ACPR, 4 place de Budapest, CS 92459, 75436 Paris) under number 16568. The authorisation can be verified on the register of financial agents (Regafi, regafi.fr) and on the ACPR website (acpr.banque-france.fr).
everyblu is not a payment institution: it does not collect or hold the funds relating to the Services, which are held and managed by Lemonway. The provision of payment services is governed by Lemonway’s Payment Services Framework Agreement, which is separate from this legal notice and from the Terms of Use, and which the relevant user accepts before opening their payment account. Lemonway’s logo, a link to its website (www.lemonway.com) and a statement of its authorisation are displayed on the Platform.
5. Nature of the Activity
The Platform is an intermediation service dedicated to port management and nautical services, connecting boat owners and captains with marinas, suppliers and technicians. As such, SYNDICO SAS acts as an online platform operator within the meaning of Article L. 111-7 of the French Consumer Code and provides users, under the conditions laid down by law and by its Terms of Use, with fair, clear and transparent information on the terms of its intervention.
6. Intellectual Property
All elements making up the Platform (structure, texts, photographs, images, infographics, drawings, logos, the “everyblu” trademark, graphic charter, software and databases) are protected by intellectual property law and remain the exclusive property of SYNDICO SAS or its licensors.
Any reproduction, representation, distribution, translation or exploitation, in whole or in part, of any of these elements without the prior written authorisation of SYNDICO SAS is strictly prohibited and would constitute an infringement offence within the meaning of Articles L. 335-2 and L. 716-4 of the French Intellectual Property Code.
7. Personal Data and Cookies
SYNDICO SAS processes personal data in compliance with Regulation (EU) 2016/679 (GDPR) and amended French Law No. 78-17 of 6 January 1978. Each user has the right to access, rectify, erase, restrict, object to and port their data, as well as the right to lodge a complaint with the French data protection authority (Commission nationale de l’informatique et des libertés – CNIL, www.cnil.fr).
These rights may be exercised by writing to contact@everyblu.com. The terms of data processing and cookie management are detailed in the Privacy Policy and, where applicable, the Cookie Policy available on the Platform. Data collected for know-your-customer (KYC/KYB) and anti-money laundering and counter-terrorist financing (AML/CFT) checks are processed by Lemonway, acting as data controller for these regulatory purposes.
8. Consumer Mediation and Dispute Resolution
In accordance with Articles L. 612-1 et seq. of the French Consumer Code, any user who is a consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of any dispute with SYNDICO SAS. With regard to the payment services provided by Lemonway, a user acting for non-professional purposes may refer the matter to the competent mediator, the AFEPAME Mediator, 36 rue Taitbout, 75009 Paris, France.
9. Hyperlinks and Liability
The Platform may contain hyperlinks to third-party websites over which SYNDICO SAS has no control and for which it cannot be held responsible. SYNDICO SAS uses its best efforts to ensure that the information published is accurate and up to date, but cannot guarantee that it is complete or that the Platform will be available without interruption.
In accordance with Regulation (EU) 2022/2065 (Digital Services Act), any potentially illegal content may be reported to SYNDICO SAS, which provides a point of contact at contact@everyblu.com and handles reports under the conditions set out in its Terms of Use.
